An easement is an interest held by one party in real property owned by another party. The owner of the underlying fee interest in the property, which is subject to the easement, owns the property subject to the rights of the easement holder, and therefore, cannot utilize the subject property in a manner which would interfere with the rights, privileges and interests of the easement holder.<\/span><\/font>

The District typically acquires the following types of easements:<\/span>

  • Conservation Easements enable the District to ensure that certain lands will not be developed or altered from their natural state, i.e. preserve wetlands or prevent development. Conservation Easements are also acquired by the District in connection with the issuance of Regulatory Permits. <\/li>
  • Access Easements provide access to District lands across lands of others. <\/li>
  • Right of Way Easements enable the District to construct, operate and maintain canals for flood control purposes. <\/li>
  • Construction Easements enable the District to implement the construction of projects. These are usually temporary. <\/li>
